Special Counsel Jack Smith on Monday moved to dismiss the federal cases against US President-elect Donald Trump -- including one for election subversion -- citing an official policy of not prosecuting a sitting president. Trump, 78, was accused of conspiring to overturn the results of the 2020 election he lost to Joe Biden and mishandling classified documents after leaving the White House, but neither case ever came to trial. Smith, in a filing with the district judge in Washington presiding over the election case, said it should be dropped in light of the long-standing Justice Department policy of not indicting or prosecuting a sitting president. He cited the same reasoning in withdrawing his appeal of a ruling by a district judge, a Trump appointee, who dismissed the classified documents case earlier this year. Smith asked District Judge Tanya Chutkan to dismiss the election interference case "without prejudice" -- leaving open the possibility it could be revived after Trump leaves office four years from now. The special counsel paused the election interference case this month after Trump defeated Vice President Kamala Harris in the November 5 presidential election. "The Government's position on the merits of the defendant's prosecution has not changed," Smith said in the filing with Chutkan. "But the circumstances have." "It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President," Smith said. "As a result this prosecution must be dismissed before the defendant is inaugurated." In a separate filing, Smith said he was withdrawing his appeal of the dismissal of the classified documents case against Trump but pursuing the case against his two co-defendants, Trump valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira. Trump, in a post on Truth Social, said the cases were "empty and lawless, and should never have been brought." "Over $100 Million Dollars of Taxpayer Dollars has been wasted in the Democrat Party's fight against their Political Opponent, ME," he said. "Nothing like this has ever happened in our Country before." Trump is accused of conspiracy to defraud the United States and conspiracy to obstruct an official proceeding -- the session of Congress called to certify Biden's win, which was violently attacked on January 6, 2021 by a mob of the then-president's supporters. Trump is also accused of seeking to disenfranchise US voters with his false claims that he won the 2020 election. The former and incoming president also faces two state cases -- in New York and Georgia. He was convicted in New York in May of 34 counts of falsifying business records to cover up a hush money payment to porn star Stormy Daniels on the eve of the 2016 election to stop her from revealing an alleged 2006 sexual encounter. Judge Juan Merchan has postponed sentencing while he considers a request from Trump's lawyers that the conviction be thrown out in light of the Supreme Court ruling in July that an ex-president has broad immunity from prosecution. In Georgia, Trump faces racketeering charges over his efforts to subvert the 2020 election results in the southern state, but that case will likely be frozen while he is in office. cl/bgs

The Titans not only scored the game-winning touchdown on a one-play drive in the fourth quarter, they also came up with back-to-back sacks. The second led to a safety, clinching a 32-27 win over the AFC South-leading Houston Texans. First-year coach Brian Callahan called how the Titans (3-8) responded crucial validation in the NFL where the only grading system is wins and losses. "We finally get a chance against a really good team on the road in the division to show what we’re made of," Callahan said. "This is the team we think we’re capable of being. It’s the team that I’ve believed in all year long." Running back Tony Pollard says the Titans have learned some important lessons that only come from fighting through adversity. They've had lots of that, which can wear out teams this late in the season. "Eventually, they’ll start turning over,” Pollard said. What’s working The offense. The Titans scored a season high in points and topped their game average with 20 points by halftime. Better yet was quarterback Will Levis both starting and finishing his first win of the season. Levis also completed his first 11 passes and connected with seven different receivers. Levis finished with 278 yards passing and threw two touchdown passes. Pollard also ran for 119 yards as the Titans played keep-away, holding the ball for more than 34 minutes. They finished with four plays of 27 yards or longer with Levis responsible for the three longest. What needs help Special teams. Coordinator Colt Anderson has been under pressure, which didn't ease after the Texans gave up an 80-yard return on the opening kickoff. The Titans then gave up a TD on the first play from scrimmage — only the fourth time that has happened in the NFL since 2000 and first since the Chargers in Week 7 in 2018. It didn't get better as rookie Jha'quan Jackson fumbled a punt recovered by Houston near midfield in the third quarter. The Titans allowed only a field goal. But special teams allowed the Texans to average 36.8 yards per kickoff return. Punter Ryan Stonehouse had a net average of 45.2 yards as he made up for a 38-yarder that counts as a shank for him with a 62-yarder early in the fourth to help flip the field. Stock up Tight end Chig Okonkwo. The fourth-round draft pick in 2022 scored a 70-yard catch-and-run touchdown that was the longest catch of his career. That one TD catch had more yards than Okonkwo had managed in any of his previous 44 games. It was enough as the game-winning TD. Stock down Levis completed his first 11 passes. He's completed 67.9% of his passes in his past three starts with five TD passes with only two interceptions with a 107.2 passer rating. Callahan likes those signs of improvement. “We definitely got to get the sack numbers down. ... We can't give up eight sacks a game and feel like it's going to be good enough,” Callahan said. The second-year quarterback has to be more aware of pressure to avoid sacks. The Titans offensive line hasn't helped much, but Levis took a beating, being sacked eight times by Houston. He's now been sacked 20 times in three straight starts since returning from a sprained AC joint in his right, throwing shoulder. He also had his third pick-6 this season. Nova, a hydrofoil ferry powered by electric motors, began operating in Stockholm late last month, offering an energy efficient new way to travel into the Swedish city, which is built on more than a dozen islands. The ferry, built by boat manufacturer Candela, skims as much as a metre above the water. In October, it took passengers on the nine-mile journey from Ekero, a suburb in Stockholm county, to the capital's city hall in just half an hour as it opened to the public for the first time, AP reported. The morning commute via an old-style diesel-powered ferry line takes 15 minutes longer without stops. It's taking to the waves in a nine-month pilot which Gustav Hemming, the city councilor in charge of climate and infrastructure, says it intended to “make more people park their cars and buy a (public transportation) card instead.” Hemming said the city introduced the service “to show the way in the green transition at sea". Candela's chief executive and co-founder Gustav Hasselskog told Zag Daily that the ferries "not only speed up the commute in Stockholm, and will do so elsewhere, but they also cut emissions drastically". “Stockholm’s public transport is largely emission-free except for the city’s vessels which use the bulk of fossil fuels used by the public transport system. They are also very costly to run,” he added. The city's 70-odd public transport vessels reporedly consume more fossil fuels than all of its trains and buses combined. Nova was the first of the firm's new P-12 model to enter service, Hasselskog said. Using computer-controlled hydrofoil wings, the vessel lifts its hull above water, which is said to cut energy consumption by 80% compared to conventional vessels. The boats, which are designed to carry 25 passengers, are operated by the city's public transport provider SL. Part of the route is subject to speed limits, but on open water the hydrofoil is free to reach impressive speeds. Nova cruises at around 25 knots (29 mph) but is capable of reaching 30 knots (35 mph) putting it some way beyond what other electric passenger ferries are capable of. Another thing going for the vessel, which can operate in waves of up to two metres, is that it's exempt from the 12-knot speed limit in Stockholm due to the fact that it leaves no wake. The restriction, with other boats are subject to, prevent waves swamping other vessels or causing erosion the shoreline, as per the news agency. Candela, which hopes waterborne transport will be also championed in other major cities like New York and Venice, says the technology cuts the energy per passenger-kilometer by 95% compared with the diesel ferries operating in the archipelago. The year 2022 saw some 6.2 million public transport boat journeys in the Stockholm region, and though these types of journey remain a small part of the public transit system as a whole, it's the fastest-growing mode of public transport following the pandemic .
